dissatisfied with any aspect of the Cookshop Plus Web site, its content, Terms
of Use, Legal Notices, Policies or Disclaimers, you agree that other than
notifying Cookshop Plus of your reason for this dissatisfaction, your sole and
exclusive remedy is to discontinue using the Cookshop Plus Web site.
Product Display / Colors
Cookshop
Plus makes every attempt to display product images on our Web site as
accurately as possible. However, we cannot guarantee that the color you see
matches the received product color, as the display of the color depends on many
factors, including the lighting and camera quality, used at the time that the
image was captured, and upon the Display Device and settings that you are
using.
Due to
changes in packaging implemented by the manufacturer, wherever manufacturers packaging
is pictured, we do not guarantee that the packaging you receive will be
identical.
Errors on our Web Site
Availability
of products and prices or services are subject to change without notice. Errors
or omissions will be corrected when discovered, and Cookshop Plus LLC reserves
the right to revoke any stated offer and to correct any errors, inaccuracies,
or omissions, including after an order has been submitted and whether or not
the order has been confirmed and your payment method charged. If you are not
fully satisfied with your purchase, you may return it in accordance with our
Returns Policy.
Limitation of Liability
In no event
shall Cookshop Plus LLC or any of its employees and/or affiliates be liable for
any indirect, special, incidental, or consequential damages including but not
limited to loss of use, loss of data, loss of business, or loss of profits.
Some
localities do not allow the exclusion or limitation of incidental or
consequential damages, so the above limitation may or may not apply to you.
Product Condition Policy
All items we sell are brand new. Cookshop Plus does not sell any refurbished, re-conditioned, or used items. Please be aware that in most cases, in order to ensure the quality of the product you receive, we will inspect that item for defects prior to shipping. This necessitates us breaking the original packaging seal. This is our normal policy and no cause for concern. The item delivered to you will still be new and unused. If you would prefer that we do not perform this inspection, please request this at checkout time.
Arbitration
THESE TERMS REQUIRE YOU TO ARBITRATE DISPUTES, WAIVE YOUR RIGHT TO A JURY TRIAL AND LIMIT THE MANNER IN WHICH YOU CAN SEEK RELIEF FOR ANY ALLEGED BREACH OF THESE TERMS TO THE FULLEST EXTENT PERMITTED BY LAW. Any dispute or claim relating in any way to these terms of use, this website, or any products or services sold or distributed by or through this website, will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims so qualify. The Federal Arbitration Act and federal arbitration law will apply to any arbitration conducted in connection with these terms and conditions, and any such arbitration will be conducted confidentially by a single arbitrator in accordance with the rules of the American Arbitration Association (“AAA”). To the fullest extent permitted by law, we each agree that any arbitration or other dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. You and Cookshop Plus LLC agree, to the fullest extent permitted by law, to waive any objection based on lack of personal jurisdiction, place of residence, improper venue or forum non-conveniens, and you agree to give up any right to a jury trial in any such arbitration or other dispute resolution proceeding.
Food Items
For health and safety reasons food purchases cannot be returned.
